In these Terms, the following words and phrases have the meanings set out below:

• Platform means the website, mobile application, and any related services operated by us.
• User means any person who accesses or uses the Platform.
• Content means all text, images, videos, maps, data, software, and other materials available on the Platform.
• User Content means any content submitted by a User, including reviews, comments, photos, videos, itineraries, and event submissions.
• Services means all features, tools, and functionality provided through the Platform.
• Affiliate Partner means a third party with whom we have a commercial or affiliate relationship.
• AI Features means any artificial-intelligence-powered feature, including Ask the Iguana and the Trip Planner.
• Mobile App means our application distributed through the Apple App Store and Google Play Store.
• Third-Party Services means websites, apps, booking platforms, APIs, and other services operated by parties other than us.

By accessing, browsing, or using the Platform in any way — including the website, mobile application, AI features, interactive maps, affiliate links, and event submission forms — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Cookies Policy.

You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Platform. By using the Platform, you represent that you meet this requirement.

If you are using the Platform on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to modify these Terms at any time. Changes take effect upon posting. Continued use of the Platform following any modification constitutes your acceptance of the revised Terms.

The Real Curaçao is an online travel guide and content platform focused on Curaçao. The Platform currently provides:

• Travel guides, blog articles, and editorial content about Curaçao.
• Curated recommendations for hotels, restaurants, beaches, activities, car rentals, and dive sites.
• An interactive map with location-based recommendations and directions.
• AI-powered features, including Ask the Iguana and the Trip Planner.
• Image recognition through Scan Curaçao.
• Weather information and forecasts.
• Events listings and an events calendar.
• Live camera feeds.
• Embedded video content (vlogs) and social media content.
• Favorites, search, and user accounts.
• Newsletter subscription.
• Affiliate links to third-party travel service providers.

We reserve the right to add, remove, modify, suspend, or discontinue any part of the Platform at any time without notice or liability.

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Platform in any way that violates applicable local, national, or international laws or regulations.
• Transmit any unsolicited or unauthorised advertising or promotional material (spam).
• Attempt to gain unauthorised access to any part of the Platform, its servers, or databases.
• Use automated scripts, bots, scrapers, crawlers, or AI tools to collect data from the Platform without our prior written consent.
• Use Platform content for AI training, machine learning, embeddings, or dataset creation.
• Reproduce, redistribute, republish, mirror, or resell any content from the Platform for commercial purposes without permission.
• Engage in data mining, API abuse, server overload, brute force attacks, security testing, or vulnerability scanning.
• Post, upload, or transmit any content that is defamatory, obscene, offensive, or otherwise objectionable.
• Create fake reviews, fake bookings, or misleading submissions.
• Impersonate any person or entity, including our staff, or misrepresent your affiliation.
• Interfere with or disrupt the integrity or performance of the Platform.
• Upload malware, viruses, or harmful code.
• Engage in phishing or any activity intended to obtain account credentials or personal data.
• Use the Platform for competitive intelligence or benchmarking without our prior written permission.
• Reverse engineer, decompile, or disassemble any part of the Platform.

Violation of this section may result in immediate termination of your access to the Platform.

Our affiliate disclosure commitments:

• Sponsored or commercial relationships are disclosed where required by applicable law.
• Our editorial opinions, reviews, and recommendations are independent and not influenced by affiliate relationships unless explicitly stated.
• Using an affiliate link will generally not result in an additional charge imposed by us. However, prices and offers are determined solely by the third-party provider and may change at any time.
• Some links may not be affiliate links. Commission rates and partnerships may change at any time.
• Prices, availability, and terms shown by affiliate partners may differ from those on the Platform.
• We only recommend services and products we genuinely believe provide value to our readers.
• We aim to disclose affiliate and commercial relationships in accordance with applicable advertising and consumer-protection requirements.

Where an affiliate or commercial relationship exists, we endeavour to make the relationship visible near the relevant link or recommendation. If you are unsure whether a link is an affiliate link, you can contact us for clarification.

You acknowledge that:

• Travel information including prices, opening hours, availability, visa requirements, border restrictions, and health and safety conditions can change without notice.
• Airline schedules, weather, political situations, road works, closures, natural disasters, and health outbreaks can affect travel plans.
• We do not guarantee the accuracy, completeness, or timeliness of any information on the Platform.
• Entry requirements may change after publication.
• You are solely responsible for verifying all travel information before making bookings or travel decisions.
• We strongly recommend obtaining appropriate travel insurance before any trip.
• Local laws, regulations, and safety conditions vary. You are responsible for researching and complying with these before and during travel.
• We are not responsible for any accidents, illness, injury, loss, or damage arising from travel activities described on the Platform.

Travel and outdoor activities in Curaçao involve inherent risks. You visit and participate in any activity entirely at your own risk.

The inclusion of any location, attraction, beach, trail, restaurant, activity, hotel, or service on the Platform does not constitute an endorsement, certification, warranty, or guarantee of its safety, quality, legality, suitability, accessibility, or continued availability.

• Beaches, swimming, snorkeling, and diving are subject to currents, waves, rip tides, jellyfish, marine life, and changing sea conditions.
• Hiking, climbing, and other high-risk activities may involve terrain hazards, falls, and wildlife encounters. Certain activities, including jumping from cliffs or rocks, may be dangerous, prohibited, or unsuitable depending on local conditions and must not be undertaken solely because they are mentioned or depicted on the Platform.
• Weather events, including hurricanes and flooding, can create dangerous conditions.
• Theft, assault, and other crime can occur; you are responsible for your personal safety and belongings.
• We are not responsible for any injury, illness, death, or property damage resulting from your use of information on the Platform.

You are solely responsible for assessing your own abilities, physical condition, equipment, and the suitability of any activity for yourself and any members of your group.

The Platform may display maps, GPS coordinates, directions, distances, and estimated travel times.

• Map data, coordinates, and directions are provided by third-party services and may be inaccurate or outdated.
• Estimated distances and ETAs are approximate and depend on road conditions, traffic, and route choices.
• You should always verify directions and locations independently, especially in remote or unfamiliar areas.
• We are not responsible for navigation errors, GPS failures, or incorrect map information.

The Platform may include AI-powered features, such as Ask the Iguana and the Trip Planner. These features are experimental and provided for convenience only.

• AI can hallucinate, produce incorrect or incomplete information, or misunderstand your question.
• AI output does not constitute professional travel, legal, medical, or financial advice.
• AI responses are generated automatically and do not necessarily reflect the views of The Real Curaçao.
• You must independently verify any AI-generated recommendations, facts, or plans before acting on them.
• We are not liable for any loss or harm resulting from reliance on AI-generated content.

Scan Curaçao and any similar image-recognition feature attempts to identify objects, locations, or landmarks from uploaded images.

• Recognition results may be inaccurate or incomplete.
• Objects and locations can be misidentified.
• Uploaded images may be transmitted to and processed by third-party artificial-intelligence or image-recognition providers, as described in our Privacy Policy.
• You should not rely on image recognition for safety-critical or identification purposes.

Weather forecasts and conditions displayed on the Platform are provided by third-party weather services.

• Forecasts can change and are not guaranteed.
• Actual conditions may differ from predictions.
• This includes temperature, precipitation, marine forecasts, UV index, and wind.
• Always check official local sources before making weather-sensitive plans.

Event listings, dates, times, prices, locations, performers, and availability are provided by organisers or third parties.

• Event details may change or be cancelled without notice.
• Performers, line-ups, and schedules may be subject to substitutions.
• We do not guarantee the accuracy of event information.
• Ticket purchases and entry are governed by the organizer or ticketing platform.

The Platform may provide access to live camera feeds from various locations. Unless expressly stated otherwise, live camera feeds are operated and controlled by third parties. We do not control camera positioning, recording practices, uptime, privacy zones, or image retention.

• Images may be delayed, low resolution, or temporarily offline.
• Cameras may be unavailable due to maintenance, power outages, or technical issues.
• Live camera feeds are provided for convenience and are not a safety or security service.

The Platform contains links to, or integrates with, third-party websites, booking platforms, maps, APIs, social media, and service providers, including but not limited to:

• Booking.com, Viator, GetYourGuide, Rentalcars.com, Airalo, Amazon.
• Google Maps, Apple Maps, YouTube, Instagram, Facebook, and other social media platforms.
• Weather APIs and live camera providers.

These links and integrations are provided for your convenience only. We have no control over, and assume no responsibility for, the content, privacy policies, terms, or practices of any third-party sites. We are not responsible for any data collected by third-party providers. Any transactions you make with third parties are solely between you and that third party, and we are not liable for any loss or damage arising from your dealings with them.

All content on the Platform — including but not limited to text, articles, guides, photographs, videos, graphics, logos, icons, and software — is the intellectual property of The Real Curaçao or its licensors and is protected by copyright, trademark, and other applicable laws.

You are granted a limited, non-exclusive, non-transferable licence to:

• Access and view the Platform content for personal, non-commercial use.
• Share links to Platform content on social media or other websites.

You may not:

• Copy, reproduce, distribute, publish, scrape, or create datasets from any Platform content without our prior written consent.
• Use our content for AI training, machine learning, embeddings, or any automated processing.
• Use our content, logos, or trademarks for commercial purposes.
• Create derivative works based on our content without permission.
• Frame, deep-link, or hotlink any content in a way that bypasses navigation or misrepresents its origin.
• Use content from the Platform in a way that misrepresents its origin or misleads users.

The Real Curaçao, our logos, slogans, and other brand elements are owned by or licensed to The Real Curaçao and may be protected by trademark, copyright, unfair competition, and other applicable laws. You may not use our brand elements without our prior written permission.

If the Platform allows you to submit content — including reviews, comments, photos, videos, itineraries, and event submissions — you retain ownership of your content but grant us a worldwide, royalty-free, non-exclusive, sublicensable licence to use, reproduce, modify, adapt, publish, translate, and display such content in connection with the Platform and its distribution partners (including CDNs and service providers), for as long as the User Content remains available on or is reasonably required for the operation, promotion, backup, or legal protection of the Platform.

You represent and warrant that any content you submit:

• Is original or you have the right to submit it.
• Does not infringe any third-party intellectual property rights.
• Does not contain unlawful, defamatory, or offensive material.
• Does not contain viruses, malware, or harmful code.
• Is accurate and not misleading.

We reserve the right to remove any user-submitted content at our discretion.

By submitting an event, you confirm that you are authorised to provide the event details and any accompanying images, logos, ticket links, and promotional materials. You are responsible for notifying us promptly of cancellations, material changes, or inaccuracies. Submission does not guarantee publication, placement, promotion, or continued listing.

Following deletion of any User Content, residual copies may remain temporarily in backups or technical systems, but will not be restored for public display except where required by law.

User reviews may be published on the Platform. We do not guarantee the authenticity of any review and we reserve the right to remove, edit, or reject reviews that violate these Terms.

The Platform allows users to create accounts. When you create an account, you are responsible for maintaining the confidentiality of your password and account information. You agree to notify us immediately of any unauthorised use of your account.

• We reserve the right to suspend or delete accounts that violate these Terms.
• We may reclaim inactive usernames.
• You may request account deletion by contacting us at the email address below.

By subscribing to our newsletter, you consent to receive periodic emails about travel content, guides, promotions, affiliate offers, marketing materials, and Platform updates. We may use analytics and tracking pixels to measure engagement. Push notifications are not currently used.

We use cookies and similar technologies for:

• Essential website functionality.
• Analytics and performance measurement.
• Advertising, personalisation, and affiliate attribution.

Where required by applicable law, non-essential cookies and similar technologies are used only after you provide consent through our consent-management interface. You may withdraw or modify your choices at any time through the cookie settings.

You may unsubscribe from emails at any time by clicking the unsubscribe link in any newsletter email. We will not sell your email address to third parties.

The Platform does not currently process direct payments or bookings. All booking transactions are handled by third-party affiliate partners on their own platforms under their own terms and conditions.

If we introduce direct booking or payment functionality in the future, we will update these Terms and notify users accordingly. At that time, additional payment terms, refund policies, cancellation policies, chargeback rules, and applicable VAT will apply.

The Platform may provide general information concerning beaches, swimming, snorkeling, diving, hiking, driving, wildlife, weather, health and emergency services. This information is provided for general informational and trip-planning purposes only. It does not constitute a real-time risk assessment, medical advice, professional safety instruction, emergency assistance or a representation that any activity, route, location or condition is safe.

Conditions may change rapidly and information supplied by authorities, operators or third parties may be delayed, incomplete or inaccurate. Users must independently assess current conditions, follow official warnings and local instructions, and use appropriately qualified professionals where necessary.

Any checklist, score, label, map, recommendation or AI-generated output is a planning aid and does not certify safety, suitability, accessibility or the absence of risk.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless The Real Curaçao and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising directly from:

• Your unlawful conduct.
• Your material breach of these Terms.
• User Content submitted by you that infringes another person's rights.

The Platform is provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that: (a) the Platform will be uninterrupted or error-free; (b) any content is accurate, complete, or up-to-date; (c) the Platform is free of viruses or harmful components; or (d) any AI, map, weather, event, or other information is reliable or fit for a particular purpose.

These Terms are governed by and construed in accordance with the laws of Curaçao (Kingdom of the Netherlands), without regard to its conflict of law provisions.

For users located in the European Union or other jurisdictions with mandatory consumer protection laws, those provisions also apply and cannot be excluded by these Terms.

In the event of a dispute, we encourage you to first contact us at hello@therealcuracao.com to seek an amicable resolution. If a dispute cannot be resolved informally, it shall be submitted to the courts having jurisdiction in Curaçao, unless mandatory local law provides otherwise.

If you believe that any content on the Platform infringes your copyright or other intellectual property rights, please send a notice to hello@therealcuracao.com containing: a description of the copyrighted work, the location of the infringing material, your contact information, a statement of good-faith belief, and a statement that the information is accurate.

We will investigate and respond in accordance with applicable law. We may also follow DMCA notice-and-takedown principles where relevant, without representing that every provision of the DMCA applies to us. We reserve the right to remove or disable access to infringing material and to terminate access for repeat infringers where appropriate.

Your use of the Platform is also governed by our Privacy Policy and Cookies Policy, which explain how we collect, use, store, and protect your personal data.

• We process personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy laws.
• Users in the European Economic Area have rights including access, rectification, erasure, restriction, data portability, and objection.
• California residents may have rights under the California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA).
• You may exercise your privacy rights by contacting us at the email below.

The Mobile App is made available through the Apple App Store and Google Play Store. In addition to these Terms, your use of the app is subject to the applicable app store terms and conditions. App Store availability is controlled by Apple and Google. We are responsible for the app and its content as provided between you and us; the app stores are not parties to these Terms.

With respect to the iOS version of the Mobile App, Apple has no obligation to provide maintenance or support services. To the extent permitted by law, Apple is not responsible for warranties, product claims, intellectual-property claims, or other claims relating to the Mobile App. Apple and its subsidiaries are intended third-party beneficiaries of these Terms solely in relation to the iOS version of the Mobile App.

The Platform does not currently send push notifications. If we introduce push notifications in the future, we will update these Terms and request your consent where required by law before enabling them.

The Platform may request access to your device location to show nearby recommendations, directions, or weather. Location data is handled in accordance with our Privacy Policy. You may disable location permissions at any time, but some features may not function fully.

Camera access is required only for features such as Scan Curaçao. We do not access your camera without your permission, and images you capture are processed in accordance with our Privacy Policy.

Saved favorites, itineraries, and preferences are associated with your account or device. We do not guarantee that saved data will be retained indefinitely, especially in the event of account deletion, device failure, or data loss, and recommend that you keep your own copies of important travel plans.

Search results are generated automatically and may not be exhaustive or perfectly accurate. Search results may prioritize relevance, popularity, proximity, editorial selection, or sponsored content. Ranking, filters, and suggestions may change over time and may include affiliate or sponsored content where disclosed.

We reserve the right to restrict, suspend, or remove any content, feature, or user account at any time without notice. We are not obligated to retain or back up any User Content.

The Platform may link to external websites, social media profiles, booking engines, maps, and other resources. These links do not imply endorsement, and we are not responsible for the content, availability, or practices of those sites.

Prices displayed on the Platform are for reference only and are generally shown in USD unless otherwise indicated. Exchange rates are determined by the payment provider or bank. Actual prices charged by third-party providers may differ due to exchange rates, taxes, fees, seasonal changes, and booking conditions.

Photographs on the Platform are intended to represent locations, dishes, accommodations, and experiences accurately, but colors, lighting, and actual conditions may vary. We do not guarantee that any location will appear exactly as shown.

Menus, prices, hours, and availability listed for restaurants are based on information provided by the venue or third-party sources. Restaurants may change their offerings, hours, or pricing without notice. We are not responsible for food allergies, allergen information, or dietary requirements; please verify directly with the restaurant.

Beach descriptions, safety flags, amenities, and access information are provided for reference only. Conditions can change due to weather, currents, algae, jellyfish, rip currents, dangerous marine life, beach closures, and other factors. Swim, snorkel, and dive at your own risk and follow local safety guidance.

Diving, snorkeling, and water sports carry serious risks including decompression illness, drowning, injury, and death. Always use certified instructors, follow safety briefings, check your own fitness and insurance, and respect local regulations and marine life.

Trail descriptions, difficulty ratings, and waypoints are approximate. Trails may be unmaintained, unmarked, or closed. Wear appropriate footwear, carry water, inform someone of your plans, and hike within your ability.

Crime and security conditions can vary by location and may change without notice. Theft, burglary, assault, vehicle break-ins, and other incidents may occur. You are responsible for securing your belongings, avoiding isolated areas at night, and following local safety advice. We are not liable for any criminal incident.

In an emergency, call the appropriate local emergency number. The Platform is not an emergency service and does not replace police, medical, or rescue services.

Any health, medical, or vaccination information on the Platform is general in nature and does not replace professional medical advice. Medication availability, medical facilities, and treatment standards may vary. Consult a qualified healthcare provider before travel and for any health concerns during your trip.

Nothing on the Platform constitutes legal, immigration, tax, or professional advice. Consult the relevant authorities or professionals for advice specific to your situation.

Prices shown by third-party providers may exclude taxes, service charges, resort fees, park fees, or other mandatory charges. You are responsible for all taxes, duties, and fees imposed by the applicable authority or provider.

We are not liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, wars, terrorism, strikes, internet outages, power failures, cyber attacks, cloud provider outages, DNS failures, or governmental action.

We do not guarantee that the Platform will be available at all times or free from interruptions, bugs, or downtime. Maintenance, updates, beta features, and third-party service issues may affect availability. We make reasonable efforts to support accessibility, but some content or features may have technical limitations depending on your device, browser, or assistive technology.

We take reasonable measures to protect the Platform and your data, but no online service is completely secure. We cannot guarantee that the Platform will be free from hacking, malware, ransomware, denial-of-service attacks, or other security incidents. You are responsible for keeping your account credentials confidential and for using secure devices and networks.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and The Real Curaçao regarding your use of the Platform and supersede all prior agreements and understandings.
